Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Country refers to: Sri Lanka
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Tweeb.lk Team.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Service refers to the Website.
  • Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  • Website refers to Turbo, accessible from Tweeb.lk
  • Private Seller means an individual who uses the website to sell their mobile phone(s) or any other tech device(s) by publishing a listing(s), with the sale of mobile phone(s) or any other tech device(s) not being their primary business or source of income, and not for profit generation.
  • Dealer means an individual, party, or company who sells mobile phone(s) or any other tech device(s) on a commercial basis using our website, with mobile phone(s) or any other tech device(s) sales being their primary business or source of income for profit generation.
  • Listing means the information published on our website by a private seller or dealer that includes mobile phone or any other tech device images, description, specifications, seller's information and the expected selling price of the mobile phone or any other tech device.
  • You/User means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Terms and Conditions 1 to 4 apply to all private sellers.

  1. OUR RIGHTS TO REJECT A LISTING IN REVIEW

    1. If the listing contains a vehicle other than mobile phone(s).
    2. Entered mobile phone's selling price is not acceptable.
    3. If the listing images:-
      1. Do not the fulfil minimum required image quality;
      2. Contains a watermark or any manipulated picture content;
      3. Contains other than mentioned mobile phone’ images;
      4. Contains that promotes or harms any other platform, a person, or third party directly or indirectly;
    4. If the listing contains information:-

      1. That is false or irrelevant;

      2. That promotes or harms any other platform, a person, or third party directly or indirectly;

        We review each listing and if the listing does not meet the requirements set out in Condition 1, we reserve the right not to publish the image and/or information (as filled), to remove the relevant image and/or information (as filled) from the listing, or to remove the listing in its entirety from the platform.

  2. LISTING AVAILABILITY AND EXPIRATION Generally, listings remain on the website for 90 days or until the posted mobile phone is sold, subject to the 3 conditions.

    Also, the user can delete the listing through the 'My Listings' tab in their profile at any time after the sale of the vehicle or before.

  3. OUR RIGHTS TO EDIT, UNPUBLISH OR DELETE A LISTING

    In case of breaching one or more of the following conditions, we reserve the right to edit, unpublish or delete the listing entirely from the website.

    1. If the user's mentioned contact details in the listing are no longer valid.
    2. If the listing is getting reported by website visitors one time or multiple times and if the reasons reported are true, appear to be true, or violate the terms and conditions of the website.

  4. Payment Requirements and Changes:

    1. There is no charge or fee to publish a listing on our website. Users can post their mobile phone listings for free.
    2. Listings will remain on the website for a period of 90 days or until the mobile phone is sold, whichever comes first. After 90 days, the listing will be automatically removed from the website.
    3. We do not handle or process payments for items sold on our website. All payment transactions and arrangements are made directly between the buyer and the seller.

Terms and Conditions 5 and 6 apply to all registered dealers on our website.

  1. OUR RIGHTS TO REJECT A LISTING IN REVIEW

    Terms and Conditions 5 is the same as Terms and Conditions 1, and applies to all registered dealers and their listings on our website, including those listed on the dealer page.

  2. LISTING AVAILABILITY, EXPIRATION AND OUR RIGHTS TO EDIT, UNPUBLISH OR DELETE A LISTING

    Generally, listings remain on the website until the posted mobile phone(s) is sold out, subject to the following conditions:

    In case of breaching one or more of the following conditions, we reserve the right to edit, unpublish or delete the listing entirely from the website.

    1. Invalid Contact Details: If the dealer's mentioned contact details in the listing(s) are no longer valid.
    2. Reporting: If the listing is reported by website visitors one time or multiple times, and if the reported reasons are found to be true, appear to be true, or violate the terms and conditions of the website.

General Terms and Conditions

  1. Liability

    1. The website does not guarantee a successful sale of your mobile phone(s) or any other tech device(s) and is not responsible for finding a buyer. Our role is limited to providing a platform for you to advertise your mobile phone(s) or any other tech device(s) for sale.
    2. The website is a platform for mobile phone(s) or any other tech device(s) listings and purchases. The website is not a party to sales contracts and is not responsible for disputes between buyers and sellers

  2. Termination

    We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

  3. Links to Other Websites

    Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

  4. Changes to These Terms and Conditions

    We reserve the right, at Our sole discretion, to modify or replace these Terms at any time.

    By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
